How to Get a Workplace Opening and Operating Licence
One of the first questions business owners ask when opening new premises, relocating, expanding or changing their line of business is how to obtain a workplace opening and operating licence (işyeri açma ve çalışma ruhsatı). This guide explains in plain terms what the licence is, which businesses it covers, the stages an application goes through and the documents you need to prepare. The aim is to help you know what to expect before you start and to avoid the mistakes that cost time.
What Is a Workplace Opening and Operating Licence, and Who Needs One?
The workplace opening and operating licence is the official permit showing that a business may lawfully operate at its location and carry out the activity it has declared. Depending on the location and type of activity, it is issued by the competent authority, such as the municipality, the il özel idaresi (Special Provincial Administration) or, within organised industrial zones, the OSB (organised industrial zone) management. Its main purpose is to protect public health, the environment, and the safety of employees and nearby residents.
The licence concerns almost every commercial, industrial or service business. Under the regulation in force, workplaces are generally assessed in three groups:
Sıhhi müesseseler (sanitary establishments): workplaces not expected to have a significant effect on the environment or human health; for example, many offices, shops and small service businesses.
Gayrisıhhi müesseseler (non-sanitary establishments): businesses whose activities carry a risk of affecting the environment, health or safety. These are divided into first, second and third class according to their level of impact.
Umuma açık istirahat ve eğlence yerleri (public rest and entertainment venues): places the public can freely enter and leave, such as restaurants, cafés, entertainment venues and accommodation facilities.
The group you fall into determines where you apply, which documents are required and whether the on-site inspection takes place before or after the licence is issued.
How Does the Licensing Process Work, Step by Step?
The workplace opening and operating licence process consists of classifying the activity, checking that the premises are suitable, completing preliminary permits, applying, inspection and issuing the licence. Not every business experiences each step to the same degree, but knowing the order helps prevent your file from being returned.
1. Classifying the activity correctly
The first step is to establish correctly where the business sits under the legislation. Even two businesses working with the same product group may fall into different classes because of their capacity, the raw materials they use or their production method. Classification directly determines which authority you apply to, which preliminary permits are required and how the inspection is carried out.
2. Checking zoning status and the building occupancy permit
The permitted use of the property in the zoning plan must be compatible with the planned activity. Situations such as running an industrial activity in a residential zone, or opening a business in a building without a yapı kullanma izin belgesi (building occupancy permit, commonly known as iskân), can block the process from the outset. For this reason, the soundest approach is to confirm the zoning status and the building's permit status with the relevant municipality before signing a lease or making a purchase.
3. Completing preliminary permits and documents
Depending on the activity, there may be permits that must be obtained from other bodies before applying for the licence. These can include a fire brigade compliance report, an ÇED (Environmental Impact Assessment) decision where required, an environmental permit or licence, and registrations under food or health legislation. For facilities with environmental impacts, the ÇED and environmental permit stages can become preconditions for the licence, so they should be built into planning from the very beginning.
4. Applying to the competent authority
Once the documents are ready, the application is submitted to the competent authority together with a declaration and its attachments. Many authorities also accept applications electronically; which channel is used may differ from one authority to another. It is decisive for the later inspection that the statements in the application match the actual situation on site exactly.
5. On-site review and inspection
The competent authority checks on site whether the workplace meets the declared conditions. For sanitary establishments, the licence is issued on the basis of the declaration and the review may take place afterwards; for non-sanitary establishments, the on-site review is usually carried out before the licence is issued. Inspections look at matters such as fire precautions, ventilation, waste storage, hygiene conditions and physical layout.
6. Issuing the licence and afterwards
The licence is issued once the inspection has a positive outcome and the relevant fees have been paid. The work does not end there: if the activity, capacity, address or operator changes, the licence may need to be updated or obtained again.
Documents to Prepare Before Applying
The documents required vary with the type of activity and the competent authority, but the list below is a good starting point for a pre-application check:
Title deed record or lease agreement
Building occupancy permit and information on zoning status
Tax certificate, and trade or tradesmen's registry record
For companies, signature circulars and authorisation documents
Fire brigade compliance report
Depending on the activity, a master craftsman's certificate or vocational qualification certificate
For facilities with environmental impacts, an ÇED decision, environmental permit or licence, or the opinion of the relevant body
Waste management records and contracts with licensed companies
Occupational health and safety documents
For industrial facilities, a capacity report and industrial registry certificate
For sectors subject to specific rules, such as food, health or tourism, registrations with the relevant bodies
Confirming the competent authority's current document list before finalising yours prevents your file from being returned because of missing paperwork. The current texts of the relevant regulations can be found through the Mevzuat Bilgi Sistemi (Turkish Legislation Information System).
Common Mistakes and Points to Watch
Delays in the licensing process usually stem not from the application itself but from checks skipped before it. Situations frequently encountered in practice include:
Checking zoning and occupancy permit status only after renting the premises or completing the fit-out
Declaring the activity in a lower-impact class than it actually belongs to
Postponing preliminary permits such as the environmental permit, ÇED or fire brigade report until the licence application
Differences between the capacity or layout declared in the application and the situation on site
Failing to update the licence after a capacity increase, new machinery or a change of activity
Leaving waste storage areas, ventilation and fire precautions until the day of inspection
Operating without a licence, or contrary to it, can lead under current legislation to administrative sanctions, up to and including closure of the workplace. Completing preparations before operations begin is therefore both easier and safer than trying to put things right afterwards.
Notes for Businesses in Antalya
In Antalya, the licensing process differs noticeably from sector to sector because of the region's economic structure. As Antalya is a metropolitan municipality, the competent authority may be the district municipality or Antalya Büyükşehir Belediyesi (Antalya Metropolitan Municipality) depending on the type of activity; for facilities in organised industrial zones, the application is made to the OSB management.
Accommodation facilities, restaurants and entertainment venues are treated as places open to the public, so safety, noise and hygiene conditions come to the fore during inspection. For facilities holding a tourism operation certificate, the relevant ministry's procedures may also come into play. For businesses opening before the season, it is important not to leave applications until the final weeks, to guard against delays that can occur during the busy period.

Agricultural produce packing and cold storage facilities, food processing plants, and businesses producing construction materials such as marble and concrete may fall within the scope of non-sanitary establishments. Addressing wastewater, dust, noise and waste management alongside licence preparation in these businesses both makes the inspection easier and prevents problems arising later under environmental legislation.
Frequently Asked Questions
Can a business start operating without a workplace opening licence?
No. Under current legislation, a workplace cannot be opened or operated without a licence. Operating without a licence can lead to sanctions such as administrative fines and closure of the workplace.
Where do you apply for a workplace opening licence?
The application is made to the competent authority according to the workplace's location and type of activity. This authority is usually the municipality; in metropolitan areas, either the district municipality or the metropolitan municipality may be competent depending on the activity. In organised industrial zones, the licence is issued by the OSB management.
Can a licence be obtained for a rented shop?
Yes, a licence application can also be made with a lease agreement. However, the property's zoning status must be compatible with the activity and a building occupancy permit must be in place. This check should therefore be carried out before signing the lease.
Does someone taking over a business need a new licence?
When a business is transferred, the licence must be issued in the name of the new operator. If the activity and premises remain the same, this can be handled as a transfer; if the activity or premises change, a new licensing process begins. During the transfer, it should also be checked whether preliminary permits and environmental documents are up to date in the new operator's name.
